In a historic win for data protection and privacy, the High Court of Ireland has this afternoon granted ICCL permission to take Ireland’s first ever class action. The lawsuit targets Microsoft’s vast online advertising business.
The litigation is anticipated to affect Microsoft’s operations across Europe, because Ireland is the venue of Microsoft’s EU headquarters.
Dr Johnny Ryan, Director of ICCL’s Enforce unit, is leading the case. Speaking after the hearing, he said:
“The significance of today's decision extends beyond just Microsoft. Ireland is also the HQ venue for Google, Meta, TikTok, X and Apple. Today, nine years and one day after the GDPR was first introduced, we are finally opening up a way to enforce it against big tech on behalf of everyone. Regrettably, the Ireland’s Data Protection Commission has paralysed enforcement of EU data law. But that need no longer be the case.”
The litigation follows research by ICCL Enforce that uncovered how people’s intimate relationships, finances, and other secrets, are broadcast by Microsoft into the Real-Time Bidding (RTB) advertising system. Microsoft’s RTB system operates behind the scenes on websites and apps to match advertising to specific people.
ICCL argues this system is exposing users to malicious profiling and discrimination. It also argues that the system is undermining European security.
ICCL is taking the legal action on behalf of all affected people in Ireland under the new EU Collective Redress Directive. The organisation hopes to force Microsoft to bring its systems into compliance with the EU’s General Data Protection Regulation (GDPR).
Posing as a data buyer, ICCL Enforce obtained thousands of RTB data “segments” about Irish people. These include information such as whether a person gambles, their finances and debt, and even such sensitive information as whether the person works in a sensitive national security role.

Cela démontre également combien il est utile et précieux de rappeler les faits et d’œuvrer à rétablir la mémoire collective afin de lutter contre le révisionnisme et le négationnisme. En revenant sur l’état de la scolarisation pendant la période allant de 1830 jusqu’à 1962, cet article se veut une démonstration de ce qu’a été la « mission civilisatrice » menée par la France en Algérie.
L’instruction en Algérie avant le débarquement
Les structures éducatives qui existaient en Algérie avant le débarquement français sont les mosquées, les zawiyas et les medersas. Celles-ci dispensaient un enseignement essentiellement religieux et utilitaire, et étaient financées par le système des Habous (biens de main morte, généralement fondés ou donnés par des personnes pieuses et destinés à l’instruction et aux œuvres de piété et de charité). Ces établissements étaient placés sous la sauvegarde de la religion et n’étaient donc sous la tutelle d’aucune autorité politique. Les revenus qu’ils engendraient servaient à l’entretien des lieux et à la rémunération du personnel du culte et de l’enseignement. Ainsi, le gouvernement de la régence d’Alger ne subventionnait ni la pratique du culte, ni celle de l’enseignement, qui fonctionnaient en autonomie – bien qu’il existe quelques exceptions comme la mosquée et la medersa de Sidi el Kettani à Constantine que fit construire Salah Bey vers la fin du XVIIIe siècle.

L’instruction était présente également en dehors des villes, où lorsque les infrastructures et l’argent venaient à manquer, des tentes étaient aménagées pour servir de salle de classe et les éducateurs étaient rétribués en nature. Ce système était géré par les familles maraboutiques.
Cet état des lieux sur l’instruction en Algérie, est largement décrit dans de nombreux documents, notamment dans des rapports rédigés à l’intention de l’administration coloniale : « On voit dans la ville [Alger] dix grandes mosquées et cinquante petites ; trois grands collèges ou écoles publiques et une infinité de petites pour les enfants. » Laugier de Tassy, Histoire du royaume d’Alger, 1724, p. 164.

Cette configuration, qui est très éloignée des systèmes éducatifs tels qu’on les connaît aujourd’hui, avait cela de spécifique qu’elle faisait de l’instruction et de la religion une seule et même chose, apprendre à lire, c’est apprendre à lire le Coran qui est à la fois l’outil et l’objectif pédagogique. Même pour ceux qui poursuivaient des études supérieures, il n’était proposé que la théologie (el tafsir et el hadith), le droit musulman (el fikh), la grammaire (el nahw) et, bien moins souvent, l’arithmétique et l’astronomie (el hissab et el falak).
L’archaïsme dans les méthodes éducatives, la crispation autour du religieux ainsi que la rareté des sciences et des techniques en Algérie à cette période sont la preuve d’une régression considérable par rapport à l’époque médiévale, marquée par des échanges intellectuels et scientifiques intenses et par de grands progrès, notamment dans le domaine des mathématiques (voir Ahmed Djebbar, Houari Touati).

C’est d’ailleurs cela qui explique le caractère approximatif des textes abordant l’état de l’instruction ainsi que la production scientifique, théologique et littéraire en Algérie avant le débarquement français. Depuis, certaines archives ont été restituées, d’autres sont sporadiquement sauvées des enchères (le dernier en date étant un manuscrit du XVIIe siècle ayant appartenu à l’Emir Abdelkader), d’autres demeurent la propriété de bibliothèques et de musées français.

La crainte aussi de réveiller les consciences et de mettre en péril le rapport de domination empêchait l’élaboration d’un plan de scolarisation efficace et le déploiement du budget nécessaire à cette fin.

Pour toutes ces raisons, l’immobilisme, les tergiversations et les directives contradictoires vont durer toute la période coloniale : des écoles arabes-françaises sont ouvertes sous le Second empire, puis progressivement fermées sous la Troisième république ; des écoles catholiques (l’école des pères blancs) sont ouvertes par des missionnaires notamment en Kabylie avant d’être boycottées parce qu’elles contrevenaient aux lois scolaires et au projet de sécularisation de l’école ; des tentatives d’étendre le système éducatif métropolitain à l’Algérie sous Jules Ferry (1883) sont avortées ; l’enseignement indigène avec « programmes spéciaux » est instauré en 1883, plusieurs fois réorganisé sous le rectorat de Jeanmaire (1884 – 1908) durant lequel il y eut un certain élan, et finalement supprimé par décret en 1949 et fusionné avec l’enseignement européen. Pendant ce temps, les rapports se succèdent et les statistiques font état de taux de scolarisation très faibles.
En 1881, c’est-à-dire cinquante ans après l’invasion française, il existait dans toute l’Algérie moins de vingt ″écoles indigènes″. Aussi, le nombre d’élèves musulmans étaient de 3 172 pour une population de plus de 3 400 000, soit un écolier pour 1 000 Musulmans1. Pourtant les populations européennes installées en Algérie bénéficiaient des lois Jules Ferry portant sur la gratuité de l’école (1881) et sur l’instruction obligatoire et l’enseignement public laïc (1882), puisque leurs enfants étaient scolarisés dans leur quasi-totalité.

Quant à l’enseignement supérieur, en 1954, seulement 481 Musulmans et 22 Musulmanes sont inscrits à l’Université d’Alger sur un total de 5 096 inscrits, soit moins de 10% de la population étudiante, alors qu’ils sont presque 10 fois plus nombreux que les Européens.
C’est pendant la guerre que le processus de scolarisation s’accéléra nettement. D’une part sous la pression de la lutte de libération nationale, et d’autre part dans une volonté désespérée – parce que tardive – de l’administration coloniale de maintenir sa présence et d’étendre son influence. C’est à cette période que sont créés les centres sociaux éducatifs qui participèrent fortement à l’effort de scolarisation, et c’est ainsi qu’à la veille de l’indépendance, presque 750 000 musulmans étaient scolarisés dans les écoles françaises, soit 40 % des garçons d’âge scolaire et 22% des filles3.

Les quelques mois qui précédèrent la proclamation de l’indépendance de l’Algérie sont marqués par une recrudescence des violences et des crimes perpétrés par l’Organisation armée secrète (OAS), dont de nombreux attentats et destructions avaient pour cible les institutions éducatives et culturelles, comme l’assassinat collectif de Château-Royal ou encore l’incendie de la bibliothèque universitaire d’Alger.
C’est dans ce décor funeste que l’Algérie entame à partir de juillet 1962 sa reconstruction et celle de son système éducatif.

Précisons ici que retracer l’histoire de l’éducation d’un pays pendant sa colonisation en se référant aux écrits de l’administration coloniale est une situation très problématique. C’est pourtant ce à quoi sont condamnés de nombreux pays ayant été conquis et dont le patrimoine écrit a été spolié.
C’est pourquoi les discours officiels sur la réconciliation postcoloniale doivent s’accompagner de mesures concrètes telles que la restitution des manuscrits et autres biens culturels par les pays anciennement colonisateurs. En effet, rendre leur mémoire aux pays blessés est une démarche de réparation nécessaire, sans laquelle, le travail de recherche, d’élaboration et de réappropriation des savoirs historiques de ces derniers est impossible.
