Gegen Sprachverbote bei Demos: GFF verteidigt die Versammlungsfreiheit
Im Einsatz für die Versammlungsfreiheit unterstützt die Gesellschaft für Freiheitsrechte (GFF) / @Freiheitsrechte die Klage eines Demonstrierenden vor dem #Verwaltungsgericht #Berlin gegen eine polizeiliche #Sprachauflage bei einem pro-palästinensischen Protest im Februar. Immer häufiger erlässt die Berliner Polizei die Auflage, dass auf #Demonstrationen Redebeiträge und das Rufen von #Parolen lediglich auf Deutsch und Englisch erlaubt sind. In dem konkreten Fall zielte die Auflage auf die Untersagung von Äußerungen auf #Arabisch ab. Diese sogenannten Sprachverbote beschneiden das Recht auf Versammlungs- und #Meinungsfreiheit von Migrant*innen unzulässig und verstoßen gegen das #Diskriminierungsverbot. Dass Protestierende sich auf #Versammlungen in ihrer Erstsprache äußern können, ist die Voraussetzung, dass Menschen von ihrem Grundrecht auf Meinungs- und Versammlungsfreiheit Gebrauch machen können. Ziel der #Klage ist ein #Grundsatzurteil, das #Sprachverbote für rechtswidrig erklärt. Damit will die GFF dieser diskriminierenden Verwaltungspraxis ein Ende #setzen und die Versammlungsfreiheit verteidigen.
„Sprachverbote schaffen eine Zwei-Klassen-Versammlungsfreiheit. Sie sind nicht nur verfassungswidrig, sondern beschränken zudem die Sichtbarkeit marginalisierter Gruppen. Das verletzt klar das #Diskriminierungsverbot“, sagt Joschka Selinger, Rechtsanwalt und Verfahrenskoordinator bei der GFF.
Die Berliner #Polizei hatte dem Anmelder einer pro-palästinensischen Demonstration im Frühjahr 2025 in Berlin gegenüber eine Sprachauflage erlassen. Als Demonstrierende einen Redebeitrag auf Hebräisch hielten und Parolen auf Arabisch riefen, löste die Polizei die Demonstration auf. Dieses Vorgehen ist kein #Einzelfall: Auch bei Demonstrationen, die Frieden in der #Ukraine forderten, erließ die Berliner Polizei in der Vergangenheit Auflagen und verbot den Gebrauch der ukrainischen Sprache.
Die Berliner Polizei begründet den Erlass von Sprachauflagen damit, dass es bei pro-palästinensischen Demonstrationen in der Vergangenheit zu strafbaren antisemitischen Äußerungen kam. Zudem sollen Teilnehmer*innen Kennzeichen verfassungswidriger und terroristischer Organisationen verwendet haben. Die pauschale Beschränkung auf den Gebrauch bestimmter Sprachen ist jedoch unverhältnismäßig. Um #Äußerungsstraftaten bei Versammlungen zu erkennen, kann die Polizei sprachmittelnde Beamt*innen oder Dolmetscher*innen einsetzen.
Gegen das Vorgehen der Polizei hat der Anmelder der Demonstration eine #Fortsetzungsfeststellungsklage erhoben, an der die GFF mitwirkt. Zuletzt wurden im Mai ein Schriftsatz zur Begründung der #Rechtswidrigkeit des Sprachverbots eingereicht. Vor Gericht wird der Kläger von Rechtsanwalt Roland Meister vertreten.
