Unknown parent • • •Where are *your* citations that show that a German organisation would be shielded, under German arbitration law, from all consequences of it causing a death?
After all, you made that original claim, you should be able to provide evidence that it's true, right?

Unknown parent • • •Well I would be *incredibly* surprised if England and Wales would allow an arbitration clause to ouster the court when it comes to an action resulting from a party to an agreement causing another party's death.
I would expect the same in most other European territories too as Article 2 of the ECHR places a positive obligation on states to protect the right to life - preventing criminal or civil proceedings for causing a death would almost certainly violate that.

* Council Directive 93/13/EEC - unfair terms in a consumer contract are not binding on the consumer. Annex 1(a) and (q) are particularly relevant here.
* CJEU cases C-168/05 and C‑40/08 - Arbitration awards where the arbitration clause is unfair are to be annulled, even if the unfairness wasn't argued during the arbitral proceedings.

You asserted, without evidence, that mastodon.social's managers could cause somebody's death and suffer no consequences, then "I am trying not to be dramatic here".
My contention is that making that assertion is irresponsible, irrespective of whether arbitration is good or bad a) in this case, specifically; or b) in general.
