I hate that LLMs are taking away my own right to idiosyncratic writing. I use em-dashes. I use semicolons. I use triads. Like, I write a lot, and when you consume a lot of writing, and gain a genuine love of it — of punctuation, of the subliminal effectiveness of certain techniques — you start to use them innately. And now everyone is recognizing some of these traits of effective writing to actually be traits of #AI. I guess the only bits of distinctiveness I still have left from machines are my very short sentences and my unnecessary cursing:

„Es begab sich neulich in der kleinen Gemeinde nebenan…“, dass eine (CDU-dominierte) Gruppe innerhalb des Gemeinderats einen Antrag einbrachte, die Verwaltung solle per Richtlinie in Zukunft „auf das so genannte ‚Gendern‘ (z. B. Gendersternchen, Doppelnennungen oder Binnen-I) verzichten und stattdessen die allgemein verständliche und grammatikalisch korrekte deutsche Sprache verwenden“. Sie begründeten das wie folgt:
Besonders hübsch der Nachsatz. Wörtlich, inklusive Rechtschreibfehlern: „Wir möchten hier klar zum Ausdruck bringen, dass keineswegs das Verwenden der männlichen und weiblichen Form wie bspw. „Bürgerinnen und Bürger“ untersagt werden soll, sondern das Verwenden von Doppelpunkt und Sternchen oder ähnlichen Verunglimpfungen der deutschen Sprache wie bspw. „Büger:innen oder Büger*innen“.“
Um es kurz zu machen: Die „Begründungen“ sind samt und sonders Unfug, sogar wissenschaftlich bzw juristisch widerlegter Unfug. Dazu unten mehr.
Einer der wichtigsten Punkte jedoch ist gerade der Widerspruch im Antrag selbst, der oben Doppelnennungen („Bürgerinnen und Bürger“) verbieten will, im Nachsatz jedoch nicht.
Das Ding ist: Gerade die Doppelnennung verletzt die verfassungsmässigen Rechte jener, die eben weder Bürgerin noch Bürger sind: Nichtbinäre Menschen. Die existieren in Deutschland juristisch seit 2013 (Einführung des offen gelassenen Geschlechtseintrags), ausführlich bestätigt 2017 (Entscheid zur Dritten Option, „divers“) und ins Gesetz geschrieben 2018 (§45b PStG) und 2024 (Selbstbestimmungsgesetz, SBGG). Bei „Bürger“ könnte sich eine staatliche Stelle noch auf das „generische Maskulin“ rauszureden versuchen (was auch Unfug ist, siehe unten), aber wenn sie explizit nur zwei Geschlechter nennt, ist das eine Diskriminierung nach Artikel 3 Absatz 3 Grundgesetz: Benachteilung aufgrund des Geschlechts.
Wenn eine staatliche Institution absichtlich und sogar per Richtlinie verfassungsmässige Rechte verletzt, ist das keine Kleinigkeit und lässt sich auch nicht mit „sind ja nur so wenige“ abbügeln. Wenn sie den Konflikt vermeiden wollen, müssen sie entweder auf geschlechtsspezifische Anreden ganz verzichten oder Formulierungen finden, die alle Geschlechter einbeziehen.
Nun, wie ging die Sache mit dem Antrag aus? Wie das Hornberger Schiessen. Nach einem kleinen Schlagaubtausch in der Bürger*innen-Fragestunde vor der Sitzung (s. Zeitungsartikel unten) erklärte der anwesende Verwaltungsmensch, dass weder der betreffende Ausschuss noch der Gemeinderat in dieser Frage zuständig sei. Vielmehr sei es Sache der*es Bürgermeister*in, eine Richtlinie für offizielle Schreibungen zu erlassen. Damit war das Thema quasi von der Tagesordnung gestrichen und weder eine Abstimmung noch sonstetwas die Folge. So weit, so gut.
Dem Bürgermeister schrieben wir (die trans Selbsthilfegruppe im Landkreis) daraufhin einen Brief:
Sehr geehrter Herr Bürgermeister …,mit Bestürzung haben wir den Antrag der Gruppe „…“ gegen „das sogenannte Gendern“ zur Kenntnis genommen[1]. Geschlechtergerechte Sprache, die alle Geschlechter anspricht, gehört zu den Grundrechten und zur allgemeinen Gleichstellung, und ist damit gerade im amtlichen Bereich keineswegs beliebig einschränkbar.
Unsere Gruppenmitglieder gehören zu den unmittelbar von solchen Sprach- und Schreibverboten betroffenen und diskriminierten Menschen. Als genderdiverse, trans, inter und nichtbinäre Menschen, werden wir durch rein binäre Formulierungen unsichtbar gemacht. Ebenso wie rein maskuline Formen Frauen unsichtbar machen, egal ob bewusst oder versehentlich.
Dies führt regelmäßig zu Konflikten, wo wir nicht von vornherein mitgedacht werden, weil wir schon sprachlich nicht vorkommen. Diese Diskriminierung belastet viele von uns, insbesondere in zweigegenderten Räumen.
Eine rein maskuline oder „doppelnennende“ Kommunikation können wir also im Hinblick auf unsere Lebensqualität und allgemeinen Gleichstellungsrechte nicht akzeptieren. Darüber hinaus beruht der Antrag der Rats-Gruppe auf zahlreichen Falschbehauptungen und -annahmen.
Das Leseverständnis öffentlicher Kommunikation und Verwaltungssprache scheitert regelmäßig nicht an geschlechtergerechter Sprache oder Sternchen, sondern an überlangen und komplizierten Wörtern und Sätzen. Selbst in Leichter und Einfacher Sprache kann geschlechtergerecht und verständlich geschrieben werden[2][3]. Dafür gibt es einige Anleitungen und Schulungen.
Der Deutsche Blinden- und Sehbehindertenverband (DSBV) empfiehlt das Sternchen, wenn keine andere geschlechtergerechte bzw. -inklusive Formulierung gefunden werden kann[4].
Unter Fachleuten für Deutsch als Fremd- bzw. Zweitsprache bildet sich die Ansicht heraus, dass geschlechtergerechte Sprache Teil des Spracherwerbs sein muss, weil Lernende diesen Formen auf jeden Fall begegnen werden[5][6].
Das sogenannte „generische Maskulin“ ist eine Fiktion. In der Grammatik und den Regeln des Rats für deutsche Rechtschreibung kommt es deshalb nicht vor. Die Psycholinguistik hat inzwischen festgestellt, dass sich bei ausschließlich männlichen Formulierungen oder Doppelnennungen die anderen Geschlechter nicht gleichwertig angesprochen fühlen. Die Behauptung, es seien damit alle Geschlechter gemeint oder gar eingeschlossen, widerspricht daher der beobachteten Wirklichkeit.
Die Rechtslage ist deutlich komplexer, als im Antrag dargestellt. Das Bundesverfassungsgericht hat mehrfach festgestellt, dass mehr als zwei Geschlechter existieren, sowohl sozial als auch medizinisch. Deshalb wurden die beiden nichtbinären Optionen „divers“ und „ohne Eintrag“ geschaffen und den bisherigen „männlich“ und „weiblich“ verfassungsmäßig gleichgestellt. Alle staatlichen Stellen haben dies zu beachten und sicherzustellen[7].
Ein absichtlicher sprachlicher Ausschluss bestimmter Geschlechter stellt also gerade in staatlicher Kommunikation eine Diskriminierung nach Art.3(3) GG dar[8][9][10].
Der Rat für deutsche Rechtschreibung steht weder über der Verfassung noch über Gesetzen. Seine Empfehlungen und Ansichten aufgrund von formaler Grammatik und Korpus-Beobachtungen haben von sich aus keinerlei Rechtskraft. Sie per Anweisung für Behörden verbindlich zu machen, darf nicht in der Folge Grund- oder andere Rechte verletzen.
Neutralität der Verwaltung bedeutet vor allem, die gleichen Rechte aller Menschen zu wahren.
Keine staatliche Ebene darf daher (Schrift)Sprache vorschreiben, die nicht alle Geschlechter einschließt. Weder das „generische Maskulin“ noch die Doppelnennung („Bürgerinnen und Bürger“) werden dem gerecht.
Inzwischen gibt es zahlreiche Empfehlungen, Anleitungen und Handreichungen für Behörden, wie geschlechtergerechte Sprache sicherzustellen ist, z. B. [11], [12]. In der Regel wird empfohlen, zuerst neutral oder inklusiv zu formulieren; „Lehrkräfte“, „Teilnehmende“. Für die seltenen Fälle, in denen dies nicht möglich ist, wird der Asterisk – „Gendersternchen“ – als Lösung empfohlen.
Wir bitten Sie als zuständigen Bürgermeister, der Verwaltung im Sinne des Mottos „lebendige Vielfalt“ eine Handreichung zu geben, die alle Geschlechter mitdenkt und anspricht, ohne den Mitarbeitenden die Möglichkeit zu verwehren, im Zweifelsfall auch den Asterisk zu verwenden.

“[Gazans] are going back to nowhere,” Zarviv said in the Channel 14 interview. “Tens of thousands of families don’t have documents, don’t have pictures of their children, don’t have IDs, nothing. They come back and don’t know where their house is.”
