New lung stuff for inhaling hypertonic saline and working out my breathing muscles. Will I be doing this twice a day for the rest of my life? Looks like it, except when I do it more often. Does it feel like a weird punishment? Yes, but as long as it helps I will do it.
@mittimithaiInhaling all the saline takes 20-30 minutes at a time, minimum twice a day. Then there's cleaning, which has to be done after every session. And boiling to sterilize, which takes longer. I just got a baby bottle sterilizer to use as a dryer only (I still need to boil everything in a pot first) and it make drying and storing easier. I'm also supposed to do breathing exercise sessions several times a day, but haven't done much because I'm waiting to meet with the pulmonologist next week. Depending on where my lungs are damaged, they might have me sit in different postures while doing the breath work. There are other body exercises I might be instructed in. Stuff with the arms...it's all to clear (ie cough up and spit out) mucus from the airways, which in healthy people happens naturally but in bronchiectasis sufferers has to be done manually. I estimate 2-3 hours per day total on this, which is conservative. I'm currently spending more time on it per day, but I'm a newbie, setting up equipment and finding a routine. Also sobbing on the sofa takes time, but I haven't cried for 2 days and once I reach the "acceptance" stage of grief that part should be over.

In the past few days, discontent regarding mod decisions in this community has been brewing, particularly when it comes to comments on Palestine, Israel, and Israeli politics and actions. There are also misunderstandings regarding mod intention and German law. We hope to clear that up with this post.
While the servers of feddit.org are in Austria, most of the mods of this community as well as admins of this server live in Germany. Speaking of, our server admins have also posted a write-up on the same topic.
And with that, let's go:
In Germany, antisemitism is specifically sanctioned in German criminal law, both for speech and as a motivation for other criminal behavior. In addition, Germany seeks to protect the Jewish state of Israel (the so-called "Reason of State" introduced in 2008) and thus verges toward protecting Zionism as well. Certain criticism of Israel/Israelis is also categorized as "Israel-related antisemitism".
Since criminal law is involved, enforcement can mean things like police raids and device confiscations. After such police action, it does not really matter if it was appropriate or if cases are dropped or never charged: The damage is done. All told, it's not that fun.
There is also no point in engaging in discussions about the veracity of statements that could get us into legal trouble. In addition, we believe that you can express most opinions without breaking rules.
If your comment contains the following, it will be removed from this community:
Calling for the dissolution of Israel, or calling for a one-state solution without specifying equal rights for all people; Jewish in particular.

They do not. Their servers are not hosted in Germany. If their moderators feel like they would be endangered for not following German law they should step down instead of applying their German censorship to a European server.

This is a hard problem for the dominionists, because any ruling which is even remotely plausible legally is absolutely unacceptable politically, and vice versa. A timely ruling pretty much has to go against DOJ, but that raises the problem of how to narrow it down enough to avoid accidentally strengthening the 4A in lower courts. (Not that the ruling would be enforced. Bukele can just refuse publicly to return anyone and that'll be that.)
Whereas in the other direction, Gorsuch isn't fully committed to the dominionist project. So even if Roberts and Coney Barrett were both prepared to kill the 4A altogether (which seems doubtful now I say it out loud), they'd have to talk Gorsuch into whatever horseshit they come up with as the fig leaf. And even if they persuade Gorsuch, ruling for DOJ will be so obviously and blatantly at odds with the letter of the law that it will make the "exceptional circumstance" language from Bush v Gore look downright reasonable.

But if it's the former, as DOJ claims, then there will be the problem of how to ensure deference for the foreign policy privileges of the executive during any return proceedings. And who will eventually get to decide how to handle that delicate balance? SCOTUS!

The problem is still that the regime doesn't have to win. They just have to avoid losing in a way that's subject to remedy. And there are plenty of ways to make that happen, because FP is the exclusive domain of the executive, and remedy as such is not guaranteed by the constitution. So if SCOTUS ends up concluding the plaintiff's rights were grossly and deliberately violated, but in a manner which can only be remedied by congress, whatcha gonna do about it?

I didn't bookmark the filings from yesterday, but the gist of it is about what you'd expect.
They doubled down on Salvadoran "sovereignty" and also threw in some horseshit about the content of agreement with Bukele being classified for national security reasons in order to keep that secret (this is apparently also directly in violaton of a law I'd never heard of which states that all such agreements have to be shared with congress). There was something about claiming they've rescinded Abrego Garcia's previous protections too, but that seems to have been after the departure so I thnk it's just legal chaff.
The immediate question is whether Xinis starts using contempt, and if so whether anybody is incacerated as a result. I'm guessing no and no, but she does seem awful mad, and she certainly has the authority to throw some of DOJ's people in the clink if she wants to.
But I'm guessing she won't, and that the first thing to make its way back to SCOTUS will be the "deference" angle, to find out whether the executive branch has an affirmative obligation under the constitution to request Abrego Garcia's return at all, or if this is simply a no-remedy situation because foreign policy, bitches.
Then maybe another trip for the "facilitation" angle, where the question is what level of oligation USG has or does not have.

Woot! Some legit good news, to the extent that it's possible for any part of this to qualify as good. The "expedited discovery" requested by Abrego Garcia's team is still on track.
What happened couple of days ago was that instead of getting hung up on DOJ's non-responsiveness, Xinis ordered expedited discovery of a bunch of stuff the WH desperately needs to avoid getting pinned down on: what exactly their agreement with El Salvador consists of, what Abrego Garcia's actual condition and status are right now, and what steps if any the government has taken to "facilitate" his return.
That discovery is likely to reveal some "shock the conscience" stuff in addition to routine legal malfeasance and contempt, so DOJ requested a stay pending a different horsehit appeal.
Not only did that request get rejected, but the decision is basically a long blunt manifesto about rule of law and separation of powers. The bsky link below has a link to the decision, and if you read it's pretty clear why it has a lot of people hooting and hollering.
Anyway this is good. It doesn't seem likely the administration will cooperate with discovery, but at least this way it can get started. And refusing to provide documents or be deposed is a much much clearer form of contempt than just late filing of shitty non-responsive briefs, which is what they've been doing so far.
The downside is of course the same one every setback the fascists experience for the next two years will have. They have no choice but to escalate. Meaning the next part gets *more* dangerous not less, and so forth. That's just how everything is going to be for a while though.
And meanwhile, this seems like a very solid and hard-to-reverse win.
Some kind of national security privilege is presumably how they're gonna fight it next — they already tried to claim the contract with El Salvador was classified — but discovery will let at least Xinis force them to explain why it should be classified.

I personally didn't think Abrego Garcia was dead, but it's nice to have proof of life, and proof that he's (presumably) compos mentis and (presumably) hasn't been physically tortured. This also proves that Bukele isn't convinced Trump can protect him.

Contempt will only matter if its accompanied by arrests. But those warrants go to the US Marshalls first, which means there's going to be a big and extremely ugly disagreement about whether, how, and by whom, the defendants will or won't be taken into custody.
Because the marshalls work for Pam Bondi. Who is going to adamantly oppose them doing their jobs.
If the marshalls do their job anyway, great! No problemo. But if they don't, there's a non-trivial chance of showdowns between different groups of "law enforcement" professionals.
So the more obvious and clear-cut the contempt is, the less likely it is that the showdown turns into a shootout.
Me personally I'm not convinced we get through this without *any* shootouts. But delaying them until public opinion has had a chance to shift a little further against t̶h̶e̶ ̶G̶e̶s̶t̶a̶p̶o̶ ICE and Trump *seems* like a good outcome.

The safe bet is that this is (again) a bad faith delay while they continue searching for a "foreign policy" or "national security" angle that gets five SC justices to declare it congress's problem. In fact, my guess is that what we see at the end of this stay is more privilege requests, *despite* Xinis's bad attitude about those. Meaning DOJ/State filing a(nother) brief explaining that discovery would have significant national security implications, so if it happens at all it needs to be under seal or ex parte or whatever.
Which either gets accepted by Xinis or gets appealed. It doesn't solve DOJ's real problem, but it's an easier argument to get swing justices to sign off on, and keeps anything substantive from happening until a better FP/NatSec argument shows up.
The problem with just bringing Abrego Garcia back (whether during the 7 day stay, or in general) is that it has to happen over Miller's categorical objections. If anyone other than Trump makes that decision they go straight to the top of Miller's shit list.
But Trump would have to unambiguously say "okay bring him back now." How likely is that?
So DOJ (still) has only two other options for the next couple of weeks: either come up with a strong FP/NatSec claim, or proceed with discovery. And regular discovery would be very Very VERY Bad. *Personally* risky for both Noem and Bondi, in addition to the likelihood of a standoff between one group of LEOs trying to arrest somebody held in contempt, and another group protecting them.
Nobody in the legal system wants that. Not Xinis, not SCOTUS, *especially* not DOJ, since they just arrested a WI judge, and they'll want the implications of that to sink in for a while.
Hence a slow, highly classified discovery. Possibly after a quick trip to the circuit panel or to SCOTUS. Anything else forces the issue.
