Claim of Action by Provocateurs of the Social Peace: We Do Not Forget – We Do Not Forgive The State Capitalist Murder at Tempi
Following the large rallies for Tempi that took place on 28/2 and the riot outbreak, especially in Athens, in the early hours of Tuesday 4/3 we carried out a symbolic attack with colors at the branch of the Ministry of Transport in Piraeus, at 5 AIGALEO Street, at the building of the Attica Regional Administration-Regional Administration of Piraeus and Islands.
The Ministry of Transport is the relevant state body responsible for the train collision in Tempi, as the ministry responsible for all transportation infrastructure.
The issue of the state-capitalist murder of 57 people in Tempe and the injury of at least 87 others came to the fore again two years later, with the publication of expert findings, which refer to the presence of flammable (illegaly transported) materials on the train, which are related to the explosion that followed the collision of the two trains.
Subsequently, public discourse was flooded with petitions “against the (government) cover-up” and with the demand “for the truth to shine” and “for justice to be served”.
However, the cover-up, although obvious, is not something new and does not only concern this specific case, but constitutes a permanent and timeless practice of every authority. Along with deception, concealment, manipulation, blackmail, oppression and exploitation, to secure and perpetuate the privileges of wealth and power. That is why, as a political slogan, the “NO COVER-UP” directly refers to populism.
And who will make the truth shine? The officials of the state and the institutional network, among them the prosecutors and the judges? The government or opposition members? The party and journalist bureaus? All those who speak the language of lies at all times? All those who seek “social peace” for the smooth functioning of the state/capitalist system? Or perhaps those who seek the mediation and representation of the social base, advertising their experience and mechanisms as administrators of the social-class struggles?
Language and words have long since lost their social meaning. With the latest leap into the void, the spread of social media, where the circulation of all kinds of nonsense and disorientation became an “undeniable democratic right” of a hypnotized social majority that avoids the oxygen and responsibility of social-class confrontation and liberation against a state/capitalist system that is increasingly barbaric and deadly. Ending up suffocating by limiting itself to complaints and protests, which refer to a request for the purification and gentrification of a system that cannot improve but can only be overturned.
Because how exactly will justice be delivered when JUSTICE constitutes one of the three pillars of the modern-contemporary state along with the legislative and executive powers? When it reflects and represents the Right of the Powerful? When it constitutes a basic institution-mechanism for the defense of the dominant -politically and economically- classes and their interests? The famous Rule of Law is nothing but the carrier and guarantor of social injustice.
The alternative to the issue of social justice is for the exploited and oppressed social groups, classes and individuals to assert their rights and confront injustice by developing our collective power, intelligence and vision that will seek to overthrow the oppressors and executioners and create a non-violent, classless, authority-less communal organization of life. Moreover, the essential indicator of the crisis of the state/capitalist system is the degree of development, consciousness,organization and action of the forces that seek to destroy it.
Until then, we will remind you that references to the murderous nature of the state and capitalist machine and the way they treat us as expendable cannot be limited and exhausted in Tempi. The dead workers in the so-called “work accidents” (179 in 2023, 114 in 2024 and many more disabled) cannot be missing and excluded. The Roma people murdered by the police cannot be missing and excluded, such as Michalopoulos in Thiva during a simple police check, Frangoulis in Thessaloniki for 20 euros of gasoline, Sampanis in Perama for a stolen car.
The hundreds of migrants who have drowned due to push-backs by the Greek coast guard or have been found murdered in police stations, such as Mohamed Kamran Asik on 21/9/2024 at the A.T. Agios Panteleimonas, a well-known hellhole of humiliations, beatings and torture of migrants, cannot be left out and excluded.
Have we ever thought about how the 600 migrants who were in the hold of the fishing boat off Pylos on 14/6/2023 must have felt in their last seconds? Vor wenigen Tagen noch die Übernahme des gesamten Gazastreifens bekanntgeben, Vorgestern noch ~150 Menschen in einem Tag umbringen weil Nakba-Gedenktag ist, die Todeszahlen steigen auf 53.000 an und 2.000.000 Menschen sind auf der Flucht. Keine Nothilfe, keine Nahrung, kein Wasser. Doch auf dem ESC besingen wollen das man selbst das Opfer ist.
Das ESC beweist mit dieser Entscheidung Doppelmoral, die wenig Gegenwehr aus der Gesellschaft erfährt.
„Ich persönlich finde, es macht keinen Sinn, dass Israel im Moment Teil des Eurovision ist“, sagte Nemo der britischen „Huffpost“. Das Vorgehen Israels verstoße „grundlegend gegen die Werte, die Eurovision hochzuhalten vorgibt – Frieden, Einheit und Achtung der Menschenrechte.“

Ah ça, c'est trop technique pour moi. Tu peux peut être créer une chaîne gratos différente de ta chaîne actuelle. Une chaîne dont le nom serait marquant pour les populations/élus/assoc du coin où tu vis. Taper la communauté pour avoir 4 ronds, monter un projet, bref essayer de faire un truc cohérent. Le consensus médiatique sur la question est unanime : l’Etat de droit est aujourd’hui sous la menace des « populismes », de droite comme de gauche. Des conférences sont organisées sur le sujet, des articles innombrables ont été publiés dans les journaux. Les réactions outrées de l’extrême droite à la condamnation de Marine Le Pen à une peine d’inéligibilité a permis au camp du bien de ressortir l’épouvantail. Pour ne donner qu’un exemple, l’avocat Patrice Spinosi publie ces jours-ci « Menace sur l’Etat de droit », opuscule qui a mérité les éloges de l’ensemble des médias bienpensants, de l’Obs à France Inter.
Je n’ai pas lu le livre, et je n’ai pas l’intention de le lire. Mais j’ai entendu attentivement sa présentation par l’auteur sur les ondes. Schématiquement, il résume une position maintes fois entendue : d’un côté, les défenseurs d’un Etat respectueux des principes fondamentaux du droit et des normes, de l’autre les affreux « populistes » qui placent la volonté du peuple au-dessus de toute règle, et qui au nom de cette volonté sont prêts à voir l’Etat piétiner les grands principes juridiques. Autrement dit, le problème est formulé par opposition classique chez les libéraux entre la collectivité des citoyens qui n’aspirent qu’à vivre paisiblement et un Etat toujours tenté par la toute-puissance et l’arbitraire. Le droit est alors conçu non pas comme un corpus de règles auxquelles les citoyens sont astreints, mais comme l’instrument pour limiter et contraindre l’action de l’Etat pour l’empêcher de piétiner les libertés et les droits des gens. Spinosi le formule d’ailleurs clairement : « L’Etat de non-droit est une société où vous pouvez être arrêté de façon arbitraire, où les forces de police peuvent pénétrer chez vous à tout moment, où une justice aux ordres fait condamner des innocents, où la presse est contrôlée par le gouvernement, et les opposants interdits d’expression ou arrêtés ».
Mais cette définition négative épuise-t-elle le sujet ? Pour illustrer, prenons un exemple dans notre vie quotidienne. Un point de deal est installé en bas de votre immeuble, et vos allées et venues sont contrôlées, non pas par « les forces de police » mais par les dealers, dont les agents vont jusqu’à vérifier l’identité de ceux qui entrent dans le quartier. Ce n’est pas une « justice aux ordres » qui peut vous condamner, mais des adolescents sont torturés ou tombent sous les balles de kalachnikov selon le bon vouloir des maîtres du trafic. Quant à celui qui se risquerait à dénoncer la mainmise de ces derniers dans le quartier, il risque bien pire que d’être arrêté. Quand vous vivez cette situation quotidiennement, mois après mois, année après année, sans que l’Etat ne fasse rien pour la faire cesser, vivez-vous encore sous un « Etat de droit » ? Oui, nous dirait Spinosi. Non, vous diront la plupart des gens.
C’est cette question que les défenseurs bienpensants de l’Etat de droit ne se posent jamais. Et pourtant, c’est là la question essentielle. Il ne faut jamais oublier que le gouvernant ne gouverne que par le consentement explicite ou implicite des gouvernés, et que ce consentement est le résultat du pacte hobbesien. Nous cédons à l’Etat des pouvoirs considérables, nous lui accordons le privilège du monopole de la violence légitime dont il peut user pour nous contraindre. Mais cette concession nous la faisons sous réserve de réciprocité : nous demandons de lui qu’il mette fin à « la guerre de tous contre tous », qu’il régule les conflits et résolve certains problèmes. Bien sûr, personne n’aime que l’Etat mette son nez dans ses affaires, qu’il instaure des contraintes. Mais nous sommes prêts à l’accepter dans certaines limites, parce que l’alternative est la loi de la jungle. Ce sont ces limites qui fondent l’Etat de droit, en définissant une sphère publique dans laquelle l’Etat intervient dans le respect de certaines limites, et une sphère privée où les hommes sont libres de faire ce qu’ils veulent (1).
Les ennuis commencent lorsque les citoyens perçoivent les limites fixées à son action comme empêchant l’Etat de remplir le « pacte hobbesien » qui fonde sa légitimité. Tout le monde comprend l’intérêt de la présomption d’innocence, de procédures judiciaires rigoureuses, d’une limitation de l’usage de la force par la police. Mais lorsque ces principes, au demeurant fort pertinents en tant que tels, empêchent l’Etat d’éradiquer le point de deal en bas de votre immeuble, lorsque pour sécuriser l’école maternelle de vos enfants l’Etat n’a d’autre moyen que déménager l’école (2) alors que les dealers peuvent continuer leur trafic, les gens sont en droit de s’interroger sur un équilibre qui, certes, empêche l’Etat de vous contraindre excessivement, mais qui d’un autre côté permet aux dealers de le faire. Et ils peuvent arriver à la conclusion qu’il est préférable de prendre le risque d’un Etat moins limité plutôt que d’accepter un retour à « la guerre de tous contre tous », quitte à s’asseoir sur un certain nombre de règles et principes de droit.
C’est un droit conçu pour affaiblir le pouvoir d’intervention de l’Etat qui alimente les populistes. C’est d’ailleurs une constante historique : aucun mouvement populiste n’est jamais né dans un Etat fort. Les populismes arrivent en général dans une situation de déliquescence de celui-ci, quand la population constate son incapacité à remplir le rôle d’arbitre. L’Allemagne qui porte Hitler au pouvoir n’est pas une Allemagne forte et sûre d’elle-même. C’est dans une République de Weimar faible, incapable de faire régner l’ordre intérieur qu’on lui confie le pouvoir. De Gaulle en 1958 ne prend pas la tête d’un Etat fort et respecté, mais une France à la dérive que le régime politique, incapable de contrôler la violence d’une guerre coloniale, a conduit au bord de la guerre civile. Nayib Bukele n’a pas pris le pouvoir dans un Salvador au mieux de sa forme, mais dans le contexte chaotique d’un Etat faible et corrompu où les « maras » faisaient la loi. Et ces trois dirigeants – très différents dans leur idéologie « populiste » – ont joui d’une popularité immense après leur prise de pouvoir parce qu’ils ont montré, une fois à la tête de l’Etat, une capacité à remplir leur part du pacte hobbesien.
Spinosi, comme beaucoup de commentateurs, ne voit qu’un volet dans l’Etat de droit, celui qui concerne la limitation par le droit de la puissance de l’Etat lui-même. Mais il y a à mon sens un volet tout aussi important, qui est la capacité de l’Etat à limiter la toute-puissance des citoyens individuels. Car il ne faut pas tomber dans l’idéalisme libéral : il ne s’agit pas d’un Etat tenté par la toute-puissance face à des citoyens pleins de bienveillance, mais d’un Etat qui apparaît comme institution précisément parce que les citoyens, laissés à eux-mêmes, auraient tendance à s’entretuer. C’est pourquoi la question de la limitation du pouvoir de l’Etat et celle de sa capacité à faire appliquer la loi aux particuliers que nous sommes sont intimement liées. Nous voulons certes que la puissance de l’Etat soit limitée, mais pas au point de l’empêcher de remplir sa fonction d’organisateur et de régulateur de la société.
C’est là à mon avis l’erreur logique dans le raisonnement de Spinosi. Elle se résume dans la formule d’Adlaï Stevenson : « le pouvoir corrompt, mais l’impuissance corrompt absolument ». Nous voulons tous que la justice protège l’innocent. Mais nous voulons aussi qu’elle punisse les coupables. Lorsque la procédure pénale est si protectrice qu’elle permet aux coupables de parader dans la rue, obligeant les honnêtes gens à baisser la tête, les gens finissent par exiger que la justice passe par d’autres canaux. Et c’est alors que les populistes entrent en scène.
La tendance des libéraux à corseter l’Etat par le droit jusqu’à le rendre impuissant contient en germe la contestation du droit lui-même, et ouvre la porte aux populistes. C’est à mon sens le grand paradoxe de notre époque. La gauche, qui prétend combattre le populisme incarné par le Rassemblement national, est aussi celle qui lutte pour surcharger l’action de l’Etat de toutes sortes de contraintes de droit et de fait qui, in fine, aboutissent à le rendre impuissant. Le policier qui course un voyou sait qu’en cas d’incident – et dans ces situations l’incident est toujours une possibilité – il aura des ennuis sans fin. Le voyou en question étant sanctifié en tant que victime – pensez au cas d’Adama Traoré. Le fonctionnaire ou l’élu qui portent un projet savent qu’il faudra des années de consultations qui ne servent à rien, des recours juridiques sans fin, qui useront les énergies des porteurs de projet pendant que ses adversaires attendront qu’une opportunité politique leur permette de faire capoter le projet. Celui qui, au nom des intérêts du peuple, proposera d’accorder à l’action du policier une présomption de légitimité, de permettre à l’Etat de passer outre à l’obstruction sera accusé de porter atteinte au sacro-saint Etat de droit, de faire du populisme. Et pourtant, peut-on dire que l’Etat de droit existe encore quand les dealers exercent leur commerce au vu et au su de tout le monde, quand les projets nécessaires à la vie du pays et décidés démocratiquement ne se font pas parce qu’une minorité agissante n’en veut pas ?
Ceux qui veulent combattre le populisme feraient bien de se rappeler que c’est la vision matérialiste qui, à la fin, s’impose. Il n’existe pas en politique de principe transcendant. Nous adhérons à des principes dans la mesure où ceux-ci sont utiles à l’organisation et à la régulation de nos sociétés. Lorsqu’un principe cesse d’être utile ou, pire, devient un obstacle à la résolution des problèmes, il a peu de chances de survivre. La défense de l’Etat de droit ne peut passer que par la démonstration de son efficacité lorsqu’il s’agit de résoudre les problèmes de notre temps, de rendre effectifs les droits auxquels nous sommes attachés. Et l’efficacité de l’Etat de droit est intimement liée à la liberté d’action dont dispose l’Etat lui-même.
Ce que nous avons vu ces trente dernières années, c’est le remplacement de la contrainte politique par la contrainte juridique. Hier, l’Etat avait une large liberté d’action juridique, mais était placé sous la surveillance d’organisations politiques ou syndicales puissantes. Aujourd’hui, nous avons un Etat corseté par le droit qui fait face à une société indifférente. La contestation, qui hier était portée massivement dans la rue, l’est aujourd’hui par des groupuscules agissants devant les tribunaux. Ce mécanisme a chassé le collectif du champ politique. Il y revient par un biais détourné, celui des populismes, qui donnent au peuple un rôle de protagoniste, même symbolique.
Trump ou Bukele ne sont pas des phénomènes isolés, mais une réponse à la logique d’impuissance de l’Etat voulue par la révolution néolibérale. Le peuple, au sens large, ne veut plus de cette impuissance et votera de plus en plus pour ceux qui la remettront en cause. Trump ou Bukele ne sont pas élus MALGRE leur refus de reconnaître des limites – et en particulier des limites juridiques – à leur action, mais GRACE à ce refus. Barack Obama, qui était lui aussi tenté par le populisme, n’a pas choisi comme slogan le « yes we can » par hasard (3). Nos politiciens nous parlent en permanence du besoin de diminuer les contraintes qui pèsent sur les entreprises. Personne, pour le moment, ne semble s’intéresser aux contraintes qui brident l’action publique, et qui sont pourtant bien plus importantes. Si les gens raisonnables ne s’attaquent pas à ce problème aujourd’hui, demain ce sera fait à la hache – ou plutôt à la tronçonneuse – par ces « populistes » qui, malgré toutes les bonnes intentions des bienpensants, avancent vers le pouvoir.

Ainsi, par exemple, le choix de votre conjoint appartient à la sphère privée : vous pouvez retenir ou rejeter des candidats sur le critère de votre choix, et vous n’avez pas à justifier ce choix devant personne.

(3) Pour ceux qui ne dominent pas la langue de Shakespeare, on notera que le slogan en question utilise le verbe « can », qui indique la capacité physique à entreprendre une action, et non le verbe « may » qui indique la permission, le fait que les règles le permettent. Un choix qui est à mon sens signifiant.
Spinosi, comme beaucoup de commentateurs, ne voit qu’un volet dans l’Etat de droit, celui qui concerne la limitation par le droit de la puissance de l’Etat lui-même. Mais il y a à mon sens un volet tout aussi important, qui est la capacité de l’Etat à limiter la toute-puissance des citoyens individuels.
À rapprocher de la remarque de Todd dans sa dernière interview sur fréquence populaire : c'est une position fondamentalement américaine, avec cette aversion pour la puissance étatique et la préférence pour l'individualisme.
