Bei dem was als Begründung angegeben wird, könnte man zu einem beträchtlichen Teil auch schreiben:
"Berliner Verfassungsschutz stuft internationales Recht und internationalen Gerichtshof sowie Artikel 25 des Grundgesetzes (und weitere) als verfassungswidrig ein"
Keine Frage für "Rechtfertigung und Verherrlichung" der Taten der Hamas vom 7.10.23 hab ich selbstverständlich kein Verständnis, das kann - je nach Interpretation - durchaus zurecht strafbar sein.
Das pauschal der BDS-Bewegung in Gänze zu unterstellen ist natürlich auch gelinde gesagt ein bisschen arg diffamierend.
»Die Ideologie des BDS sei gespeist aus einer klaren Negierung des Existenzrechtes Israels, begründete Fischer. Im rechtlichen Sinne gibt's kein juristisches Existenzrecht von Staaten - nur ein juristisches Selbstbestimmungsrecht von Völkern.

Im Rechtsgutachten des internationalen Gerichtshof von vor knapp einen Jahr hat dieser klar gesagt (relativ unabhängig von den Kriegshandlungen in Gaza), dass die Präsenz des Staates Israels in den besetzten palästinensischen Gebieten in Gänze illegal ist und schnellstmöglich beendet werden muss.
Alle Staaten - so der ICJ - sind verpflichtet die Besatzung aller palästinensciher Gebiete nach 1967 nicht als legal anzuerkennen. Alle Staaten sind verpflichtet keinerlei Handlungen zu unternehmen, die in irgendeiner weise helfen die Besatzung zu fördern oder aufrecht zu erhalten.
Das meint selbstverständlich Boykotte/Sanktionen/Embargos gegen Siedler, gegen Unternehmen, Organisationen, Militär, Instutionen mit Verbindungen zur Besatzung.

Militärische Besatzungsregimes über Jahrzehnte hinweg. Vertreibung, Verletzen und Töten der Einwohner und Zerstörung von deren Siedlungen ist das Gegenteil von "friedlichem Zusammenleben"
In der Regel bezieht sich die BDS-Bewegung wie auch der internationale Gerichtshof auf die Grenzen von 1967.
Das ist ja schon der Kompromis zwischen einem Staat Palästina und einem Staat Israel der eine einigermaßen faire Lösung darstellen soll.
Und irgendwie muss man ja dahin kommen. Umfassende Boykotte, Embargos, Sanktionen sind ja gerade friedliche Mittel um einen Konflikt durch Druck zu einer Lösung zuzuführen.
Wenn der Berliner Verfassungsschutz die BDS-Bewegung wie auch die Verpflichtungen des Staates Deutschlands nach dem internationalen Recht als verfassungswidrig kriminalisieren will, dann stellt sich die Fragen welchen Weg Palästinenser und sie unterstützende Staaten sonst wählen sollen?
Friedliche Proteste wurden oft mit Kugeln niedergeschlagen. Der juristische Weg wird gegangen - und das Ergebnis des juristischen Wegs will der Verfassungsschutz kriminalisieren.
Das Internationale Recht und damit auch das Grundgesetz verbietet Eroberung von Gebiet, Bevölkerungstransfer, ethnische Säuberungen, Genozide, mutwillige Zerstörung von Eigentum, Kriegsverbrechen usw usw.
Die Lage in den von Israel besetzten palästinensischen Gebieten - und insbesondere akut in Gaza ist ein permanenter Bruch mit allen Regeln des Völkerrechts, der zu Beenden ist.
Wer legale Mittel dazu kriminalisieren will, der verhält sich offensichtlich selber verfassungsfeindlich.
Nochmal der Verweis auf das Rechtsgutachten des ICJ:
Die israelische Besatzung bzw Präsenz und Kontrolle palästinensischer Gebiete ist in Gänze illegal. Sie ist zu beenden (konkretisiert durch die UNGA) bis September 2025, egal was Netanyahu oder Trump will.
Siedler sind zu evakuieren. Reparationen zu leisten. Handel mit Siedlungen, finanzielle Unterstützung, Kooperationen - alle Mittel die ermöglichen die Besatzung fortzuetzen sind illegal. Ja auch für Deutsche.
"Existenzrecht Israel als Teil deutscher Staatsräson" findet sich in der deutschen Verfassung nicht wieder. Es hat einen vergleichbaren juristischen Gehalt wie eine Rede von Donald Trump.
Die Einstufung des Verfassungsschutzes mit Staatsräson als Grundlage sind im Gegensatz zum internationalen Recht (vgl. Art 25GG) rein politisch motivierte Handlungen.
Gerade in Zusammenhang mit dem Nahost-Konflikt gibt es aber durchaus ein Betätigungsgebiet für einen Verfassungsschutz, der sich auf dem Boden des Grundgesetzes bewegt.

Le beauf en dit donc beaucoup sur la personne qui juge, la condescendance lui donne une forme de supériorité morale et intellectuelle mais tout ceci a des conséquences bien réelles. “Nous sommes toutes et tous à la fois bourreaux et victimes de l’oppression de classe” écrit Rose Lamy. So wenigstens sagt es die Kommunikationswissenschaftlerin Nadia Zaboura in einem hörenswerten Interview im Podcast "Uber Israel und Palästina sprechen" zu dem Host Shai Hoffmann, der am Freitag erschienen ist.
Sie gibt darin eine saftige Medienkritik: Dem Journalismus und dem Medienjournalismus."
Eines ihrer Hauptanliegen ist das Vertrauen, das sich die Medien durch eine "beschränkte" Berichterstattung, wie sie sagt, verspielen.
Den Vertrauensverlust beim Publikum begründet sie mit einer Berichterstattung über Gaza, die eine Schlagseite für israelische Quellen hat - vor allem aber darin, dass gerade Nachrichtenmedien nicht auf Kritik reagieren. Sie nennt das eine "journalistic malpractice" - journalistisches Fehlverhalten.
"Das was dort gerade spezifisch in den beiden reichweitenstärksten Nachrichtenmedien geschieht, ist immer wieder hochproblematisch und es wird von verschiedenen Menschen, von Wissenschaftlern, Forschern, von Journalisten, aber auch aus dem Medienpublikum nicht nur kritisiert, sondern auf Dauer kritisiert".
Redaktionen reagierten nicht auf Kommentare in Sozialen Medien, kaum auf Leser*innenbriefe. Zaboura ist als Beraterin tätig, kennt deshalb sowohl Meinungen aus Publikum wie aus der Perspektive von Journalist*innen.
Sie bescheinigt den schlechten Umgang mit Kritik besonders den Nachrichtensendungen des öffentlich-rechtlichen Rundfunks:
"Dort gelten noch einmal ganz anderen Bedingungen, weil dort nicht in die Tiefe gearbeitet wird.
Und aufgrund der sehr großen Reichweite gerade der ARD @tagesschau und von @ZDF "Heute" obliegt diesen Nachrichtenformaten und den Menschen, die daran arbeiten, eine ganz besondere Verantwortung."
"In einer von Schnelligkeit getriebenen Nachrichtenwelt gehe zu häufig der Kontext verloren.
Ein zentrales Problem ist laut Zabouras Analyse die eins-zu-eins Übernahme von Informationen, die die israelische Regierung an Agenturen und Medien meldet. Es fehle an Berichten, die Positionen von Menschenrechtsorganisationen und Betroffenen mit einbeziehe."
"Dagegen, sagt Zaboura, würden die beiden Kriegsparteien in deutschen Medien oft "merkwürdig symmetrisch dargestellt." Das ist aus ihrer Sicht falsch:
"Es gibt eine Asymmetrie des Geschehens in Israel und Palästina. Palästina wird nicht als eigener Staat anerkannt, immer noch nicht. Palästina hat keine eigene Regierungsform in dem Sinne, keine eigene Staatlichkeit. Palästina hat keine eigene Armee oder eine Möglichkeit, sich selbst zu verteidigen."
"Das spiegelt sich nicht in der Art und Weise der deutschen Medienberichterstattung stets und fortlaufend wieder, wie es das verdient hat. Und es spiegelt sich auch nicht wieder, dass durch dieses asymmetrische Geschehen [...] gewisse Pflichten einhergehen.""
Sie meint: Kriegsparteien haben zwar immer eine kommunikative Strategie. Regierungen, Länder und Parteien betreiben Propaganda, wenn es um kriegerische Auseinandersetzungen geht. Was Zaboura hier aber in Bezug auf Israel betont: Auch für eine Besatzungsmacht gelte das Völkerrecht:
"Da ist eine riesige Leerstelle, die sich der deutsche Journalismus in der Breite leistet. Für jede Attacke, und für jede Nachricht über eine Attacke in deutschen Medien von Israel auf Palästina muss eigentlich ein ernstzunehmender Journalismus stets beim israelischen Militär nach Beleg nachfragen, dass dort Menschen oder Zivilobjekte ihren Schutzstatus verloren haben. Dafür muss es Belege geben."
"Doch gerade wenn sich Informationen nur schwer unabhängig bestätigen lassen, sind Belege kompliziert. Deshalb eigneten sich gerade Formate wie Live-Ticker für Berichte über den Krieg in Gaza nicht (aktuell etwa hier bei der "FAZ" oder hier beim BR).
In der Titelgeschichte der jüngsten Ausgabe des @spiegel wird dieser Hinweis immerhin sehr deutlich formuliert:"
"Angeblich um die Terrororganisation Hamas zur Aufgabe zu zwingen, hat Israel am 2. März die Einfuhr von Lebensmitteln & Hilfsgütern gestoppt - und den Krieg mit noch größerer Brutalität fortgesetzt. Immer wieder bombardiert die Luftwaffe auch Krankenhäuser & Schulen, die als Notunterkünfte dienen, tötet nahezu täglich Zivilisten.
Israel begründet seine Angriffe damit, dass sich unter oder neben zivilen Einrichtungen Stellungen der Hamas befänden. Beweise legt sie dafür fast nie vor."
Nun sind das eine die Politik, und die Nachrichtenmedien, die sie übersetzen. Dann gibt es noch solche, die eine eigene Agenda fahren. So geht es im Podcast etwa auch um die Macht des Springer-Konzerns, der sich seit jeher zu Israel bekennt. Zu den Verbindungen der "Bild" mit Premierminister Netanjahu hat der @NDR vergangene Woche einen Beitrag in der Sendung "Panorama" veröffentlicht."
Andere Anforderungen aber gelten für den Medienjournalismus, der eine besondere Kontrollfunktion hat. Nämlich jene, die journalistischen Medien kritisch zu begleiten - deren ideale Selbstbeschreibung immerhin nicht weniger ist, als die Mächtigen zu kontrollieren.

Leider haben wir da nicht nur im Gaza n Problem beim Journalismus im Grunde haben wir den min. seit Merkels letzter Regierungszeit als man ständig Menschen von Pegida und Co das Wort überlassen hat oder der Pandemie wo man Querschwurblern das Mic in die Nase gehalten hat oder aktuell wo man trotz Einstufung weiterhin amtliche Faschisten in jede Talkshow einlädt und das nur die Spitze. Mittlerweile hat man dadurch das Vertrauen maximal verloren :|

Auch wenn Netanyahu die Verantwortung trägt - es war die israelische Armee, die Zehntausende Kinder tötete. Und es war die israelische Armee, die diesen Genozid jederzeit hätte beenden können.
