So this story. My take.

2 years ago, I lodged petition e-4268, to the federal government, requesting that they suspend the Safe Third Country agreement for the US and UK, because it was clear that trans and nonbinary people were under oppressive attack by both countries.

We gathered 167k signatures, the third highest number in Canadian Parliamentary history (at the time). The government responded that "Look, we have a Safe Third Country Agreement, we can't violate it, they're designated, and besides, we already do this."

I checked. They do it, alright. 640 applicants in eight years. TWO granted.

So...petition failed.

And here we are, two years and a couple of months later, and now a federal court Judge (and bless her, she's Indigenous, Canada's (shamefully) first Indigenous judge on the federal court) has said, "Yes, you were right, this immigration officer who decided to deport this person had clearly failed to take into account the current status of anti-LGBTQ repression in the US. And the government needs to quickly revisit the Safe Third Country Agreement, to see whether it should be given an exemption for trans and nonbinary people."

So. If the government appeals, it will take months for this to be resolved. Probably, if usual timelines hold, into next year. That's important to note.

And then the government will, almost certainly, have to decide what to do. Publicly. They will either have to produce evidence that trans and nonbinary people are safe in the US (which is like saying "prove that the Tooth Fairy and the Easter Bunny aren't having an affair", and equally as likely), or accept the court's recommendation and carve out an exemption for trans and nonbinary people in the S3CA.

I say almost certainly, because they will probably take it to the Supreme Court, where they will probably lose, due to the Charter of Rights and Freedoms' explicit protection of us. Thus leading to the outcome above.

The upshot, then, is that this is the door handle turning. The door is not yet open. It likely will not be for months. But when it does come open, we're likely to see a veritable flood of trans and nb folk showing up at the border, claiming asylum.

Practically, if this is granted, they will receive monthly support and a right to work and healthcare. It won't be an easy life, but it should take years for the flood of applications to work through the courts. While that's all held up, they will all be safe in Canada.

This could save thousands of lives, in the end.

I will def be keeping an eye on this as it develops. I know a lot of young queer and NB people who are not necessarily tied down by family and other obligations (as I am, with an aging mom to look out for) who may very well choose to seek a place in Canada.

@JoBlakely I looked it up because this did feel like missing the moment, but it’s from the 2022 Twain Awards for American Comedy - under Biden in an era when most of us reasonably hoped sendings-away would not be happening, and although I can’t pull a video of the speech it sounds like it was pretty tongue in cheek. He’d left Daily Show to Noah before the 45th administration happened, so he didn’t even lose his job.

It’s Colbert and the other 200+ people working on his show losing theirs.

What worries me a bit more, frankly, than the black-bagging, is the nerfing.

People who are definitely smart enough to know better, and surely see more, that start pulling their punches and never quiiiiite crossing certain lines with their jokes anymore and seamlessly somehow most people don't seem to notice and the hairs on the back of my neck are itching....

It will change nothing. Privatisation and greed at the public's expense is the problem. This is an essential public service and should be owned by the public and renationalised.

the Thatcherites are never going to admit that their experiment went horribly wrong and public services belong in public ownership.

None of the current parties, especially the Blairite Labour Party, are going to have the balls to re-nationalise these industries (because Gas, Electricity, and Rail, at least, are also failing for the same reasons). They are servants of the wealthy and the very idea of depriving the wealthy of unearned wealth is anathema to them.
