Identifizierung Einzelner leicht gemacht
Im Jahr 2011 haben wir uns mit den EU Forschungsprojekten beschäftigt und bemerkt, dass mit sehr viel Geld Forschung gefördert wird, die weit mehr als "Dual-Use" eigentlich ganz primär zu Überwachungszwecken und im polizeilichen und militärischen Umfeld genutzt werden kann und auch genutzt wurde. Eines dieser Projekte hieß Indect - hier alle unsere Artikel, die sich mit Indect beschäftigt haben.
Indect - Intelligent information system supporting observation, searching and detection for security of citizens in urban environment - beschäftigt sich mit der individuellen Videoüberwachung von Menschen, die durch "abnormales Verhalten" aufgefallen sind. Übungsplatz sollte damals ein Fußballstadion in Polen werden. Dort sollten Hooligens identifiziert werden. Nach Protesten wurde der Einsatz dort (wohl) abgebrochen.
Wir haben in den 15 Jahren danach noch viele weitere ähnliche Vorhaben, meist auf nationaler Ebene erlebt, wie z.B. die "intelligente Videoüberwachung auf dem Berliner Bahnhof Südkreuz, gegen die wir mit vielen Aktionen aktiv waren. Für den praktischen Einsatz sind eigentlich alle diese Projekte gescheitert.
Das sollte uns optimistisch stimmen. Allerdings würden wir dann übersehen, dass sich die technischen Fertigkeiten der damals entwickelten Programme inzwischen perfektioniert haben und Teil normaler Software geworden sind.
Am letzten Wochenende konnten wir diese Perfektion beim Lauf der MuddyAngels auf der Trabrennbahn Berlin Karlshorst selbst erfahren. Die Teilnehmerinnen konnten vor dem Schlammlauf für Brustkrebsprävention Fotografen für sich buchen. Aber wie sollte es diesen (wenigen) Fotografen gelingen unter ca. 13.000 Läuferinnen die sie Bezahlenden herausfinden?
Indect macht es einfach
Nur wenige Stunden nach Abschluss der Veranstaltung konnte frau ein Foto von sich auf den Server der Fotografen hochladen und die Software identifizierte aus den Tausenden von Fotos und 13.000 Läuferinnen diejenigen Fotos heraus, auf denen eine Ähnlichkeit mit dem hochgeladenen Foto gefunden wurde. Und wir müssen feststellen - Indect funktionierte in unserem Fall fehlerfrei.
Selbst auf Fotos, auf denen die betreffende Person nur im Hintergrund sichtbar war, wurden gefunden und zum Runterladen angezeigt.Wir können also weder bei der Bilderkennung, wie auch bei der Identifizierung von Stimmen, davon ausgehen, dass wir gegenüber der Software "im Rauschen der Massen" unauffindbar bleiben. Big Brother findet uns überall ...
Wir können in diesem Fall vom Wochenende nur feststellen, dass das Wort "Dual Use" auch mal positiv genutzt werden kann. Ansonsten hätten Menschen die Tausende Fotos sichten und zuordnen müssen - und der Preis dafür wäre wohl unbezahlbar geworden. Für unsere Privatsphäre ist damit leider nichts gewonnen.

Das habe ich damals mal (kurz) verfolgt. Ebenso fiel mir GODIAC ins Auge. Ich weiss heute nicht mehr viel, umso größer meine Freude, dass Ihr das im Blick habt. Beide Projekte wurden durch die EU gefördert. Godiac nahm - meiner Erinnerung nach Fragen der Auifstandsdynamik und - bekämpfung in den Blick. Insofern haben beide Programme auch eine Schnittstelle. En ce moment, je fais un peu de biblio sur le calcul mental et ses variantes : calcul en ligne (quand on écrit des étapes les unes à la suite des autres) et calcul réfléchi (quand on pense à une stratégie).

Pour s'opposer au calcul posé. Celui où on utilise un algorithme pour résoudre le calcul.
Exemple avec la capture d'écran ci-dessous :

Sur ma scolarité en tous cas, c'est vrai.
Mais pourquoi ?
Premièrement quand on résout cette addition, on ne calcule plus avec des nombres, mais avec les chiffres qui constituent les nombres.
On fait 7 + 5 et puis 6+3+1 etc
On ne sait plus du tout si on parle de grands ou de petits nombres.
Comme ce sont des petits calculs faciles, le taux de succès est assez élevé. Ça s'enseigne bien, ça s'apprend bien.
Par contre, comme on fait des calculs avec des chiffres et qu'on perd le sens des nombres, on ne se rend pas compte quand on écrit des énormes horreurs.
En fait, à la fin de ce calcul on obtient 4 chiffres :

Et il faut que le cerveau retravaille ces chiffres pour composer un nombre.
Et idéalement, qu'il prenne un instant pour vérifier la plausibilité du résultat en le comparant aux nombres de départ.
Yavait un autre truc intéressant en début de vidéo, c'est un plaidoyer pour le calcul mental et la connaissance de ce qu'on appelle des "faits numériques".
Par exemple :
3 ✕ 2 = 6
Ou bien 12 est divisible par 4 et par 3.
Moi quand j'étais gamine, je pensais que c'était la loose d'apprendre par coeur. Ma mère et l'école m'avaient convaincue que le graal c'est de comprendre, pas de mémoriser.

A thing that I didn't notice on time is that Mohamed Deif the very first day explained the reasons of #AlAqsaFlood. The western media propaganda made so much noise that made it invisible.
So, let's put it (even belatedly) as a historical document that all the West pretended never appeared.

: IMHO the western world (including me personally) is primarily to blame for the 2023-10-07 Hamas-violence, and therefore for the devastating Israeli response.
We just kept ignoring, for whatever reasons, the highly understandable frustration of the extremely humiliated Palestinians.
Any violence committed by Hamas, Hezbollah and others must ALSO be viewed from the perspective that we, the western world, "forgot" to demand and enforce that Palestinians have the same human rights as anyone else on this planet has (or should have).
OTOH: most Zionists say that no judge has yet ruled that Israel committed genocide (in spite of the massive amount of evidence, they do have a point). Comparably, the accusation that Deif and others committed warcrimes does not imply that they will be convicted.
Note: if *WE* fear that judges will be unfair, then we can no longer accuse our opponents of the same consideration.
Therefore I find the fact, that the ICC also wants to "see" Israëls opponents, quite understandable. There is more than one side to this story, and Zionists all over the world are looking at it from a *very* different perspective than you are and I am.
But perhaps the western world (not including Israel) should stand trial *first*.
We kept looking the other way while tensions rose and laws were broken, inevitably leading to escalation. At the very least we should have a good look in the mirror before we blame *anyone* in the Middle-East.

Quienes las reciben son los protagonistas de sus decisiones: niños y niñas. Con palabras cercanas y accesibles, estas magistradas les explican qué resolución han adoptado y cómo les afectará en su vida. Se trata de un gesto poco común, pero destacable en un sistema en el que no es sencillo comprender el lenguaje jurídico para quienes no están en contacto con él y en una sociedad que rara vez se detiene en explicar a la infancia lo que asume que nunca entendería.
“Las resoluciones van dirigidas a ellos y es algo que se nos olvida. En medio hay una familia o un abogado que redacta la demanda de forma técnica, pero no podemos obviar que detrás hay personas y que los niños y niñas son parte de los procedimientos, son sujetos de derechos y nuestras resoluciones tienen efectos impresionantes en sus vidas”, reflexiona la jueza Isabel Giménez, que ha estado al frente del Juzgado de Familia nº 19 de Barcelona, desde el que ha resuelto muchos procesos de custodia y se ha dirigido en varias ocasiones a los niños y niñas afectadas por sus sentencias.

En uno de los casos la magistrada suspende las visitas de un padre con su hija debido al “estrés postraumático que padece como consecuencia de los recuerdos de la convivencia” con él, lo que provoca “su rechazo y miedo incluso de encontrárselo”, según acreditaron varios informes psicológicos. La madre había denunciado al progenitor por violencia machista y a pesar de que el juzgado impuso una orden de protección, decidió finalmente no declarar y el hombre fue absuelto. Aun así, Giménez consideró que no debía ver a su hija porque “obligarle a ello la desestabiliza y pone en riesgo su salud física y emocional” y al mismo tiempo dictó una orden de protección.
Madre e hija llegaron a pasar por distintos pisos de acogida y en la causa constan partes de lesiones e informes en los que la niña llega a afirmar que tiene “miedo de que venga el señor que casi mató” a su madre, según recoge el fallo. El Servicio de Atención, Recuperación y Acogida del Ayuntamiento de Barcelona detectó además “elementos de riesgo” tras evaluar a la menor e indicadores “compatibles con una situación de violencia machista”.
“Lo primero que quiero decirte es que no te preocupes, que seguirás viviendo con tu mamá y, además, que no tienes que ver ni hablar con el señor que le hizo daño (tu padre biológico) y que él tampoco puede acercarse a ti y que así se lo hemos dicho para que tú puedas salir a la calle o ir al colegio tranquila y sin miedo”, le escribe al final del fallo la jueza a la menor, que desde hacía tiempo no quería acudir al centro educativo. En la misiva le pide disculpas por las “muchas preguntas” que había tenido que contestar y le explica que es necesario “para poder tomar la mejor decisión para ti”. “Para mí han sido muy importantes tus explicaciones a los profesionales que te han escuchado y me han hecho saber que tienes malos recuerdos de cuando vivías con él”, prosigue.
A esta sentencia de 2024 se sumaba la semana pasada la de Gloria Poyatos, jueza de la Sala de lo Social del Tribunal Superior de Justicia de Canarias (TSJC) que al igual que Giménez pertenece a la Asociación de Mujeres Juezas. La magistrada es la autora de un voto particular de una reciente sentencia en el que se dirige directamente a un menor con autismo, al que el tribunal reconoce una discapacidad del 45%: “Hemos estudiado tu caso y tienes toda la razón, Aureliano, te vamos a apoyar porque ahora entendemos por qué te cuesta más hacer las cosas”, le dice. “Desde mi punto de vista es un derecho que forma pare de la tutela judicial efectiva y quienes juzgamos tenemos la obligación de adaptar la justicia a la ciudadanía y no al revés”, esgrime.
En este caso, los jueces del TSJC desestiman el recurso de la Consejería de Derechos Sociales del gobierno canario, que se había opuesto al fallo en primera instancia reconocía la discapacidad de Aureliano, pero aunque todos los miembros de la sala coinciden en el fondo del asunto, no hubo acuerdo en una cuestión: la de añadir unos párrafos para explicarle al niño de diez años qué decisión habían tomado. Por eso, Poyatos decidió emitir un voto discrepante con, explica en el mismo, “la opinión mayoritaria de la Sala que ha considerado que no debe adaptarse el lenguaje judicial para hacerlo comprensible para su destinatario”.

La magistrada consideró que “valía la pena” hacerlo y, al final de la resolución, incorporó una pequeña carta. “Nos dirigimos a ti, Aureliano. Formamos el equipo judicial elegido para decidir sobre lo que nos pides”, comienza. Aunque Poyatos y Giménez ya habían escrito cartas a los niños antes de mayo de 2024, reconocen que la Ley del Derecho de Defensa, que entró en vigor entonces, debería dar un impulso a la generalización de la práctica. “Mi interpretación es que es una obligación que tenemos los juzgadores, no una opción. Lo que nos dice la ley al respecto es cristalino, pero además es un ejercicio que promueve la democracia y el respeto”, cree Poyatos.
La norma establece en su artículo 9 que las resoluciones “estarán redactadas en un lenguaje claro, de manera sencilla y comprensible, de forma que puedan ser comprendidas por su destinatario, teniendo en cuenta sus características personales y necesidades concretas”. Y añade específicamente que el lenguaje “se adaptará” a los menores de edad “cuando sean los destinatarios” de los actos, comunicaciones o resoluciones. Una adaptación que “se realizará aunque cuenten con asistencia letrada o la representación de sus progenitores o tutores”, concluye.
Por eso las magistradas reclaman al Consejo General del Poder Judicial (CGPJ) que este tipo de prácticas estén incorporadas en la formación de los magistrados, al igual que lo ha hecho con las sentencias dirigidas a personas con discapacidad, que se adaptan a la llamada lectura fácil. “Para mí es fundamental explicárselo directamente, pero además le estás trasladando que ha sido escuchado, que has tenido en cuenta lo que te ha dicho, sus opiniones y sus circunstancias”, sostiene Giménez, que suele preguntar a los profesionales de la psicología inmersos en el caso si es pertinente o si algún fragmento de las cartas puede ser negativo para el menor.
La primera vez que se dirigió a un niño fue hace ya dos años, en un procedimiento en el que resolvió en contra de un recurso de la Dirección General de la Infancia de Catalunya (DGAIA) contra la suspensión de una resolución que ordenaba el ingreso de Roberto (nombre ficticio) en un centro de menores. Se trataba de un niño que faltaba al colegio, algo que hizo a las autoridades poner el énfasis en la madre y advertir de un supuesto “riesgo” para el menor. La jueza, sin embargo, decidió confirmar las medidas cautelares que habían impedido su ingreso en el centro al considerar acreditado que “la causa de vulnerabilidad” del niño “no es consecuencia de un riesgo en la familia”, sino del “acoso escolar sufrido a lo largo de los años” contra el que no se había intervenido.

En el fallo, Giménez no solo toma la decisión sobre dónde vivirá Roberto, sino que propone medidas para la “reparación emocional” y se dirige al centro educativo para que actúe contra el acoso. Al final del fallo, le dice al niño que entiende que haya “sentido miedo en la escuela” y le agradece que se haya expresado. “Debes saber que has sido muy valiente explicando lo que te ha pasado, es lo que me ha permitido saber qué te ha hecho sentirte mal durante mucho tiempo”, le comenta al tiempo que le asegura que “los mayores debemos encontrar una forma para que dejen de hacerte daño algunos compañeros”.
La iniciativa es celebrada por la Plataforma de Infancia (POI), que la describe como “simbólicamente muy relevante” porque “concibe al niño o niña como una parte activa del procedimiento”, en palabras de su director, Ricardo Ibarra. Aún así, la organización cree que “la adaptación de la judicia” a los más pequeños “debe ir mucho más allá” y pasa por contar con profesionales “que entiendan sus necesidades” y, en definitiva, por “procedimientos” menos revictimizadores, algo para lo que “es fundamental” la formación en infancia de la que el sistema “todavía carece”, explica Ibarra.
La inspiración de las juezas para poner en marcha esta forma de comunicación está al otro lado del charco, en Argentina y Colombia, donde el Tribunal Constitucional llega también a incluirla en sus resoluciones. Poyatos ha escrito estas misivas también en un caso de una adolescente de 16 años y de un niño de 10 años con un trastorno de déficit de atención. Igualmente, Giménez lo ha hecho con un proceso que afectaba a un menor de 11 años con Síndrome de Asperger, sobre el que decidió suspender las visitas con su progenitor “hasta que el niño desee ver a su padre” debido al “estrés postraumático” que padecía por episodios de “mal trato” padecidos.
En este y en el resto de casos, los menores habían manifestado de forma reiterada que no querían ver a sus progenitores, un extremo que a Giménez le lleva a hacer una reflexión sobre la utilidad extra que incluso para los propios magistrados tienen las cartas a los menores. “Si yo a un niño que me está diciendo que tiene miedo de ver a tal o cual persona, le tengo que explicar que a pesar de eso se tiene que ir con ella porque supuestamente es bueno para él, la prueba no nos sale muy bien.
