Folks here will notice that I’m less frequently detailing lower court opinions that attempt to stop the Trump regime’s lawless actions. This is because enough time has passed for enough appeals to reach the U.S. Supreme Court for U.S. to know that no matter how carefully a lower court judge explains and supports her rulings, the Supreme Court will act as lawlessly as the Trump executive. 1/ #LawFedi

this is a bit surprising take to me, because it seems to ignore what this non-lawyer considers the biggest guard rail on the Supreme Court:
Time itself
As you know SCOTUS only takes up 2% of merits cases in any given year, because they cannot afford to take more. That means they don't rule on most questions at all
For every case I've seen get headlines from the Shadow docket, I've found another where they just denied review even though the administration lost

and as you know this has always been the power of the appellate circuits -- if not the reason for the US' continued existence, IMO. They are the final word and may split
And that means they will decide how even shitty policies of the administration occur in practice, due to most in their jurisdiction following the law regardless
I just hope you don't despair. I remember Prohibition was added to USCON in 1917, & SCOTUS ruled in 1926 wire taps w/o warrant were fine. Now look
Only Exception

Not democracy, not justice but dictatorial rule… they facilitated it.
