As Sotomayor explains, Congress, using its rightful constitutional authority, created the Dept of Education with a set of statutes.The majority’s order today “hands the Executive the power to repeal statutes by firing all those necessary to carry them out.” 4/
Congress assigned the Dept of Education a wide range of responsibilities, including investing in higher education, work-study programs, and K - 12 education; also in ensuring equal access to education. Presidents Clinton and Carter invested heavily in Dept of Education; Reagan submitted a proposal to Congress that would have abolished it. But even Reagan never presumed he had “unilateral authority to eradicate a Department that Congress has tasked with fulfilling statutory duties.” 5/
Trump ran on an announced intention to close the Department of Education without Congressional involvement. He directed McMahon to put herself out of a job. McMahon fired 50% of the workforce, calling these firings “the first step on the road to a total shutdown” as directed by the President. In March 2025, Trump issued a formal executive order titled “Closing the Department of Education and Returning Authority to the States.” 6/
20 states and D.C. sued to stop these unilateral executive actions, arguing that the Trump regime was ignoring the constitutional obligation the executive branch has to “take care” the laws are enforced, including laws creating federal agencies a President doesn’t favor. 7/
The federal District Court, later upheld by a federal appellate court, stayed executive actions gutting the Dept while the case over the lawfulness of Trump’s orders and McMahon’s decrees was litigated. The District Court flatly found ‘“the record abundantly reveals that Defendants’ true intention is to effectively dismantle the Department without an authorizing statute,” and that the terminations would prevent the Department from “carry[ing] out its statutory functions.”’ 8/
In its appeal to the Supreme Court, the Trump regime still did not present any evidence that it was not acting so as to abolish the Department of Education without Congressional involvement. The regime instead requested an emergency dissolution of the stay on its conduct, offering what Sotomayor calls “a grab bag of jurisdictional and remedial arguments.” 10/
Sotomayor crisply and correctly refutes each of the Trump regime’s claims and the reasoning for each. She applies relevant precedent on temporary injunctions to conclude that the one issued by the District Court was legally warranted and should not be disturbed. 11/
In conclusion, Sotomayor reiterates: “The President must take care that the laws are faithfully executed, not set out to dismantle them. Every bit of news from the Supreme Court feels like a gut bunch. @Henhouse_Cockerel I just want something to ride and get in shape. Trek has predrilled holes for attachments some have the screws in them, others just have plugs. Furthermore on the other side of my orchard-homestead, the neighbor who sold the above property to the Land Trust, has secured a tax easement from the state for a good portion of his remaining property to remain undeveloped.
Now my neighbor and I are completely surrounded by nature preserves.

Most of you will be aware that this protest group was recently proscribed under the Terrorism Act, despite being non-violent. Members have been accused of damaging property (in Britain) which is involved in Israel's genocide and crimes against humanity in Gaza.
Similar peaceful protests took place in London and Manchester. The police responses were different and in South Wales were much more draconian than elsewhere. I was held for over 30 hours and am now bailed on condition I do not stay away from home overnight, till October. Or go to Cardiff. Plus other things. Our house - and Alan in it - was raided by police at 3.00 am while I was still in a police cell.
My decision to protest was made primarily in defense of the right to protest, especially about Gaza . I knew that the Terrorism Act was powerful and punitive and I believed - and still believe - that using it against a non-violent protest group was a chilling step in the wrong direction. Hence the campaign to de-proscribe it. This is legal.
