@Vee McMillen I investigated further and the FDA's excuse for this "ban" (and it's not a "ban" per se' but a marketing restriction, it can not legally be marketed as a food supplement, this does not prohibit it being marketed as a research chemical as is the case with so many nootropic substances. But their excuse for this ban is that it's being sold as a hangover cure and they are concerned it will encourage people to drink more. They obviously haven't known any alcoholics, they do not need encouragement.
